Wirefly Refer a Friend Program
Terms and Conditions
- By submitting a referral through the Wirefly Refer a Friend Program (the "Program"), or purchasing from Wirefly through a Referral Link (as defined in Section 2 below), you agree that your participation in the Program is subject to these "Terms and Conditions".
- Individuals that refer a friend through the Program ( each a "Referring Customer"),or purchase at least one mobile device with a qualified carrier service plan through a Referral Link (as defined below) (each a "Referred Customer" together with a Referring Customer, "Participants"), shall earn a reward for each Qualified Referral (as defined below). A "Qualified Referral" is a referral through the Program that results in the purchase of a mobile device together with a qualifying carrier rate plan through a Referral Link, as determined by Wirefly (Simplexity, LLC) in its sole discretion, that (a) results in Wirefly receiving full and complete payment from the Referred Customer; and (b) is not deactivated or any feature or rate plan downgraded for a minimum of 90 days after the activation date. A "Referral Link" is a personal URL assigned to each Referring Customer to be used to refer a friend through the Referral Portal (as defined in Section 4 below) and/or other CANSPAM compliant communications to make a qualifying purchase from www.wirefly.com.
- Referring Customers and Referred Customers will each earn a Twenty-five Dollar (US $25) reward for a Qualified Referral, redeemable for either merchant offers available in the Referral Portal (as defined in Section 4 below), or cash payable via PayPal ("Rewards"). Participant acknowledges that third party terms and conditions, and account registration, may apply to the redemption of merchant offers and/or the PayPal service. REFERRED CUSTOMERS ARE LIMITED TO 1 REWARD PER QUALIFYING CARRIER RATE PLAN. REFERRING CUSTOMERS ARE LIMITED TO 1 REWARD PER REFERRED CUSTOMER IN A 2 YEAR PERIOD. Rewards will not be earned on previous purchases not made through a Referral Link.
- Referring Customers and Referred Customers will have access to the Wirefly referral portal where they can refer friends and family to Wirefly via email, Facebook, Twitter, and Blogger and track their earned and redeemed rewards (the "Referral Portal"). The Referral Portal requires registration and is password protected. The Referring Customer/Referred Customer is solely responsible for securing its username and password and shall have full liability for any actions taken using the same.
- Rewards will be fulfilled within 30 days of a determination of a Qualified Referral. Wirefly will notify and provide redemption details to Participants via the email addresses provided during registration or purchase, as applicable. Participants are solely responsible for any and all tax liability that may result from redemption of Rewards.
- Participant acknowledges and agrees that all information collected through the Program, including without limitation, through the Referral Portal, shall be used and maintained in accordance with the Wirefly Privacy Policy available at http://www.wirefly.com/about/privacy.
- The Program may not be combined with the Wirefly Affiliate Program or Wirefly Partner Programs or offers. Unless otherwise specifically stated by Wirefly, a Referred Customer may not use any other discounts or promotions in conjunction with his/her purchase through the Referral Link.
- Employees of Simplexity, LLC, its parent, subsidiary and affiliated entities, and their respective advertising, promotional, fulfillment and marketing agencies, agents, partners, and their immediate family members and/or same household members (spouse, parents, children, roommates) of any such person, are not eligible to participate in the Program.
- EACH PARTICIPANT AGREES TO, AND HEREBY DOES, RELEASE AND HOLD HARMLESS SIMPLEXITY, LLC, ITS PARENT, SUBSIDIARY, AND AFFILIATED ENTITIES AND PERSONS, EMPLOYEES, DIRECTORS, PARTNERS, AGENTS AND REPRESENTATIVES, FROM AND AGAINST ANY CLAIMS, ACTIONS, LOSSES, DAMAGES, OR LIABILITY OF ANY KIND, INCLUDING WITHOUT LIMITATION, ANY DIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, WHICH PARTICIPANT OR ANYONE ELSE MAY INCUR OR SUFFER IN CONNECTION WITH OR RESULTING FROM PARTICIPATING IN THE PROGRAM OR FROM THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY REWARD. IF FOR ANY REASON THE PROGRAM CANNOT BE RUN AS PLANNED, OR IF TAMPERING, UNAUTHORIZED INTERVENTION, ACTIONS BY A PARTICIPANT, FRAUD, TECHNICAL FAILURES, OR ANY OTHER CAUSES, IN SIMPLEXITY, LLC'S SOLE OPINION, CORRUPT OR AFFECT THE ADMINISTRATION, SECURITY, FAIRNESS, INTEGRITY, OR PROPER CONDUCT OF THE PROGRAM, SIMPLEXITY, LLC RESERVES THE RIGHT, AT ITS SOLE DISCRETION, TO DISQUALIFY ANY PARTICIPANT AND/OR TO CANCEL, TERMINATE, MODIFY OR SUSPEND THE PROGRAM OR ANY PORTION THEREOF, OR THE ISSUANCE OF ANY REWARD, AT ANY TIME. PARTICIPANT ACKNOWLEDGES AND AGREES THAT SIMPLEXITY, LLC MAY CANCEL, TERMINATE OR MODIFY THE PROGRAM AT ANY TIME FOR ANY REASON.
- Participant agrees that: (a) any and all disputes, claims and causes of action arising out of or in connection with the Program and/or the Reward shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Virginia, Alexandria Division or the state courts of Fairfax County, Fairfax, Virginia; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event are to include attorneys' fees.

When you sign up for the Wirefly Refer A Friend Program by clicking through to our referral page, you will be able to send referrals to your contacts by email and social media. You can also log into the Referral Portal at [URL] to refer friends and family at anytime.
How many referrals can I make?
There is no limit to the number of referrals you are allowed to make.
How do I qualify?When one of your referrals purchases a mobile device with a qualifying service plan through your referral link, and does not deactivate the service or downgrade any feature or plan for at least the first 90 days after activation, you will both receive $25, in accordance with the Terms and Conditions of the Wirefly Refer a Friend Program [URL].
How much will I earn?
When one of your referrals purchases a mobile device with a qualifying service plan through your referral link, and does not deactivate the service or downgrade any feature or plan for at least the first 90 days after activation, you will receive $25 per qualifying rate plan, in accordance with the Terms and Conditions of the Wirefly Refer a Friend Program [URL].
When will I receive my rewards?
Within 30 days after Wirefly's determination of a qualified referral, Wirefly will notify you that you are eligible for a referral reward and how you can redeem it. [SEE BELOW]
How will I receive my rewards?
If you are the referring individual: Within 30 days after Wirefly's determination of a qualified referral, Wirefly will notify you that you are eligible for a referral reward and how you can redeem it. You will then be able to select your reward from the list of available merchants in the Referral Portal or opt for a cash transfer via Paypal.If you are the referred customer: Within 30 days after Wirefly's determination of a qualified referral, Wirefly will notify you that you have earned a referral reward. Your reward will be fulfilled by a PayPal electronic fund transfer and mailed to the email address provided upon purchase.
What types of rewards can I receive?
If you are the referring individual: You will be able to select your reward from the list of available merchants in the Referral Portal or receive a PayPal fund transfer.
If you are the referred customer: You will receive your reward as a PayPal fund transfer.
Can I add my referral to an order that has already been placed?
To qualify for the reward, referred customer MUST order from your referral link. Referral credit cannot be applied after purchase is completed or to an order placed directly on wirefly.com.
Can my referrals call in their order?
No. To qualify for rewards, referred customers must purchase a mobile device with qualifying service through your online referral link. Orders placed by phone will not be eligible for rewards.
Is there a minimum purchase to qualify for a referral reward?
Your referral must purchase a mobile device with a qualifying carrier service plan. Phone only, prepaid phones, and accessory orders are not eligible for referral rewards.
Can I refer myself?
No. We will not issue referral rewards for self-referrals.
Can I use Wirefly Coupon Codes and still be eligible for a reward? Yes, purchases made through a Referral Link using Wirefly Coupon Codes will still be eligible for a reward unless otherwise stated in the coupon disclaimer. The coupon code must be provided at the time of purchase as it cannot be added to the order after an order is submitted.
If I find another price on the same phone, will you price match?
No. Wirefly does not price match. The price you see on our site is the price of the device.
